Why is receipt date different on the I485/EAD.
I am reading some of the posts from other members.
Their receipt data on the EAD is different(at least 1, 2 months delayed) from the date USCIS actually received their application. I thought USCIS is going to honour the actual date when they received the application by mail.
It is obviously more than 2 months late for many of the applications.
If some one to use AC21 portability, what exact date is honoured? the date when USCIS received the application or the receive date printed on the EAD?
Is the date when USCIS received is stored some where?
In my case, I filed my I485 on July27 at TEXAS Service Center, I received a notice on Oct 6 from CALIFORNIA Service Center, Details below :
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Notice Date : Oct 2, 2007

Dont waste time. Fill the FOIA form whatever you can only for "140 approval notice" (one page). They will use those info and send you the approval letter. It may take 1-3 months. At least you can give a shot. If you get it then resubmit FOIA with the A#. FYI- you can not fill two request same time. Once one is completed then you can send second one.

Hi ,
Finally after a long wait i heard some good news from my lawyer that my labor from PBEC has been approved.
I have few questions in regards to my H1-B visa extension . The labor that got approved was from my previous company PD March2003 and i also have labor pending for my current company PD Feb2005.
I wanted to apply for three yrs extension on my H1B I will be completing my 5th yr in Feb 15th 2007 and would like to know if i can get 3yr extension after premium processing i-140 bec based on some of the post on IV i came to this conclusion that one has to be in/past their 6th yr term on H1b according to AC21?
Secondly, i would like to know if i can use copy of approved i-140 from my previous company and get 3yrs H1b extension.

It will never happen here. Even if it does happen, it will still have an annual quota, which would lead to priority dates.

If the priority dates are not current for the category in which your parents are seeking a green card, then they will have to wait for the priority dates to become current before they can apply I-485. You can check the Visa Bulletin for more info.

If your future wife is not in the US now, she will apply directly at the consulate for her L-2 visa. There is no need for you or her to get prior approval from CIS, like you do for the L-1. Your question is unclear, so I don't know if this answers it.

We filed our 485 on July 2nd 2007 at Nebraska office � EB3 � July 7, 2001
- The case was shifted to Texas and we received notices from Texas office with receipt date of August 27.
- Our date is now current however processing at Texas is still stuck at June 27, 2007.
- Does this mean our RD is now 08/27/07 even though it was recd. at Nebraska on 07/02/07??
Unfortunately yes - RD Aug 27, you can confirm this by looking at your receipt notice that you got from your attorney.

Wondering if we need to Pay $80 towards Biometric Fee when Renewing I-131? paid the Biometric Fee last year when Applied for the First Time.

My labor was filed in Feb 2003. I got my 45 day letter last year or so and was replied by my employer. But still now no word on it? What do you suggest? Are we supposed to contact USCIS through my attorney?

My passport is expiring in March. I live in NY metro . Does anyone knows the procedure to renew the passport while in the USA. Please share your experience.
Its very easy and simple. Go to NY Indian Embassy web site and follow the procedure/process to renew passport. It takes about 1-2 weeks, after you mail the old passport along with other documents, for Indian Embassy to process and mail you back the new passport. Good Luck!

Ok! Thought of starting this thread to track EAD/AP/FP notices and updates for early july filers. This way we can see if there is any kind of pattern going on. My details below:
I-140 cleared from TSC
485 filed july 2nd with NSC
Checks cleared on 9/4 and got RN# starting with SRC (TSC)
USCIS Case update shows "Last update" as 9/3 for EAD/AP.

hi, first, I'm not trolling. I have a genuine question and I'm looking for answers seriously. I got laid off in 2009 while on a h1b and then for one reason or another, stayed back for 8 months. My understanding was that I could have gotten a new job within 6 months and then switched over my h1b. I was foolish. My I-94 on the h1b approval letter however had an expiration date of October 2011. By the time 8 months had gone by, I decided it was time to give up hope and return to my country.
Since I've been here, my parents have started a campaign to get me a bride. Arranged marriages are part of my culture, and people marry based on how good a match it is according to one's birthchart. If I do find a USC who is willng too marry me, will it help me in any way immigration wise? Or will my 8 months out of status stay in USA chase me for the rest of my life?

A colleague and I both filed EB2 PERM labors at around the same time in 2005.
Our 140s got approved roughly together too/
We both also applied for 485 on July 2nd, through the same lawyer, and both applications went to TSC.
Both of us saw our checks get encashed on the same date.
Here's where our applications diverged.
He received an LUD last friday and his EAD card has been ordered.
I received an FP request today(monday) but no LUD updates.
Although our applications are a bit dis-similar (he is married, i filed single), I have this theory that USCIS is splitting their queue, so as to not bombard its internal departments with the flood of work that has recently come in.
It makes total sense to split people into two groups (atleast), and for each:
a) send them EAD cards with a note of FP pending.
b) send them FP notices and do their EAD later.
(I know another friend who is in group a, while I'm in b)
Yes, we all like to bitch and moan about USCIS, but thats generally emo-talk.
So, has anyone else noticed this, or can anyone help me understand what I'm missing here.
This is just me speculating, but I'd like to throw this thought out there and have it rebound with your inputs.

Also, you can see, EB1+Eb2ROW has s always been in the 50-70K range every year

I have recently filled the USCIS survey. But I am not satisfied with all the questions they have. I want to tell what we want to tell (not what they want to hear)
I have an idea to send USCIS director information about how they are doing ? (In terms of delays, consistency, customer service, implementation, transparency). This will not cost any dime to anybody and at the same time make an impact.
Step One:
One of us can first create a survey on survery monkey (detailed one..with complete description about various aspects of USCIS) . I have created a Draft of the questions which can go in the survey. You can add more (Please do not delete the existing ones).
The real survey can contain scale of measurement (1 to 10) and also descriptive comments. I can keep the draft open for 10 days before creating/publishing the real survey so that everybody can contribute to creating it. Here is the link to the draft (feel free to add more questions which are to the point and can make an impact)

Is it advisable to change jobs? I'm planning to join bearing point consulting comp where they would start GC only after one year. As you guys know consulting job is quite unsecured. Only advantage with the new company is career growth.
Or should I wait for the outcome of lawsuit

I tried a few times for scheduling infopass trying to get Boston which is closer to where I live. But I am getting Lawrence....I guess Boston office is flooded with appointments...Didn't know that Lawrence has a office too.
