I had spoken to couple of Attorneys and they have told me that H1B will done with in two weeks this year. Therefore, anyone looking to apply, get your ducts lined up.. There is not much time left..

If the question didn't showed up - then it has been removed. Its as simple as that - isn't it. The question cannot magically show up for some and not for others.

You need to carry both passports. The VISAs on the older passport remain valid unless they were explicitly voided.

I have filed for the position for "Progammer Analyst " in company A. I applied for I485 after I140 approval and it has been more than 180 days. I work for company B but in totally different position(unrelated to programmer analyst).
I just got a job of "Programmer cum Instructor" from company C who is transferring my H1. I do not know if I can invoke Ac21 or not. In case yes, then I think I will never have to join company A. Am I right ?

My wife needs an EAD to apply for medical residency in the US. We have our EAD application pending (receipt date Aug 27th). We know we will get our EAD eventually. But the problem is more complex.
For medical residency, programs call candidates for interviews in Nov/Dec. So they start offering interview slots in Sep/Oct timeframe. If you don't have an EAD card or EAD-approval notice, they will not even consider you. They don't care if you say that EAD will definitely come by Dec (or something like that).
We tried our local congressman, but even he said he couldn't do anything
until the 90-day processing time had passed. We tried the local INFOPASS office and submitted an expedite request, but that got denied.
So we are urgently looking for ways to get my wife's EAD ASAP. If we don't get the EAD in time, my wife will lose an year and in medical residency, every year you sit at home counts (against you).
Does anyone here have any ideas what we can do ! Note: This EAD is needed for *education* purposes and not for *gainful* employment.

We have the same situation. I am the primary and got my GC last July. Spouse still does not have it. We have a PD of Sep 2005 and 485 RD of Sep 2005. No idea what is happening. We also have contacted our Congressman, Senator, and done Infopass and SR. Our case was originally filed at VSC, transferred to TSC and is now at a "USCIS Office"

NO, you cannot interfile. A Family-based priority date, cannot be used in connection with employment-based. If you are married to a U.S. Citizen, and you already have an approved I-130, you can apply to adjustment of status immediately through the U.S. Citizen. You file AOS now and it may get approved much faster than the employment-based. Once you file the new I-485 through family, you generally should withdraw the employment-based. But wait until you receive a new EAD via the new I-485.

Krilnon is right. I will clarify the whole making t-shirts thing later, but in a nutshell, feel free to set up a store and resell your own t-shirts if you want. If the shirt design is kirupa.com related and I (and maybe a few others) think it looks cool, I'll feature it on the site as well.

Ok, here is the situation. I am the guy in this venture with all the business contacts and would have to involve in some email conversations with the clients and also visit them on an occasional basis.
I am willing to do this without pay and also appoint someone as CEO instead of me. Can I be the Chairman of the Board, and do this kind of work.

If you are in Eb1 you should get your GC soon.
If your profile is incorrect please correct it.
If you have a EAD and AP, AP is allowed for emergency. With a GC you an file a form for extended vacation

I have a question regarding my spouse who is on H4 visa.One of the company did H1b processing through "CONSULAR PROCESSING". Her H1B is approved now.
1) She is ready to work from Oct 1st as she got some project.Her employer said that they have to apply for amendment(COS) to get I94.Is this right?
2) How many weeks will it take under premium processing to get new I94
3) Do they have to apply only after Oct 1.
4) Are there any chances of getting rejected at this stage.
Can any one please suggest.

I am looking for a lawyer , who has office in both Delhi and in USA , so they can take care of the complete process.

Otherwise you can get an attorney here. Most of the paper work is done here. All you need to do is to take packet for the interview.

The other day had a friend at my place and I felt like throwing him out of my house. These guys are crying by their asses days and night. Believe me he is the guys whose wife drives him to work because his DL expired and PA DOT is not issuing him License because he has less than 1 year visa. But he was talking this government, that government..... I asked him to keep quiet and watch, if we are successful you'll get a free ride, if not then keep crying through your ass, you're doing it anyway!!!!

I asked my company attoreny about this.. he said that immigration petition is I-140 and as I-140 is not filed for your wife (I-485 is already filed for my wife) so I should say No there for my wife's form.

Actually I have an L2 not an L1...hence the need of an EAD before the green card...
Now that you have the GC, quit worrying about expired EAD and all that crap. Enjoy the freedom and privileges of green card life. Don't worry about trivial things like EADs now.
